ProcessInformation for PartiesThis document has been prepared to assist persons who are involved in an appeal concerning the identification and/or special education placement of an exceptional pupil to the Ontario Special Education Tribunal (English and French) (the "tribunal") under section 57 of the Education Act. In this document, the person requesting a hearing before the tribunal is referred to as the "appellant" and the school board or the school authority as the "Board". The appellant and school board are the parties to a hearing. This guide is for information only. Parties should also refer to the Education Act and its regulations, the Statutory Powers Procedure Act (the "SPPA") and the tribunal Rules of Procedure.
Rules of ProcedureTribunal has established Rules of Procedure for appeals. The Rules are available in both French and English. The Rules of Procedure ensure that the tribunal's proceedings are fair by providing for an effective and expeditious process that all parties must follow. They expand upon the minimum procedural rules set out in the Statutory Powers Procedure Act which apply to all administrative bodies in Ontario. For persons seeking a plain language description of the tribunal and its procedures the tribunal has prepared a document titled Information for Parties. However, readers are cautioned that it is Ontario legislation and the Rules that govern the way the tribunals function.
